1. Acceptance of Terms
By downloading, installing, or using DailyPoints ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
DailyPoints is a points tracking application designed for families, classrooms, and groups. The App allows users to track points, manage members, and share access with other users through Apple's iCloud service.
3. Account and iCloud
To use DailyPoints, you must:
- Have a valid Apple ID and iCloud account
- Be signed into iCloud on your device
- Have iCloud Drive enabled
You are responsible for maintaining the security of your Apple ID and for all activities that occur under your account.
4. User Conduct
You agree not to:
- Use the App for any unlawful purpose
- Upload or share content that is harmful, offensive, or violates others' rights
- Attempt to gain unauthorized access to the App or its systems
- Interfere with or disrupt the App's functionality
- Use the App to harass, abuse, or harm others
- Share access with unauthorized individuals
5. Content and Data
You retain ownership of all content you create within the App (names, avatars, point records, etc.). By using the App, you grant us a limited license to process this content solely to provide the service.
You are responsible for ensuring that any content you upload does not violate any third party's rights or any applicable laws.
6. Family and Group Sharing
When you invite others to your family or group, you grant them access to view and modify shared data. You are responsible for managing who has access to your group. We recommend only sharing access with people you trust.
7. Children and Parental Responsibility
DailyPoints may be used by children under parental supervision. Parents and guardians are responsible for monitoring their children's use of the App and for any activity that occurs under accounts they create for their children.
8. Intellectual Property
The App and its original content, features, and functionality are owned by DailyPoints and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAILYPOINTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.
11. Termination
We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may stop using the App at any time by deleting it from your device.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the App after such changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
